DWI Laws and Some General Mistakes People Made Print E-mail
Saturday, 19 May 2007
Getting arrested for DWI offense is a serious issue. It is generally seen that after being arrested for DWI misdemeanor people start committing a series of other questionable activities (that may sometimes come under some crime in the eyes of law). Once arrested under Texas DWI laws, you must take care that you are cool and calm, and behave properly to remove any doubts the officer would have on you. People, mostly in haste, tend to make certain mistakes during their arrests that lead them to appear guilty in the court.

Here is a list of some general mistakes people usually commit once they are arrested for a DWI. Study these mistakes and try to avoid them, in case, you get arrested under Texas DWI laws.

a) Assumptions: Most people make a major mistake by assuming that they would lose the case once they get arrested. Try to understand that the case against you may not be as strong as you think. There are several points that may favor you in this case. Only a good attorney can find out this. Succumbing to the arrest and losing hope would not do any good to you. So, have courage and be prepared to fight for your rights.
b) Not Fighting Against Automatic License Suspension: You have the right to request a hearing and save your driving license within 15 days of your conviction, under Texas law. In case, you fail, you cannot prevent the automatic suspension of your driver’s license. Hence, you must concentrate on saving your driver’s license during the stipulated period of time suggested by your state, otherwise it may not be so simple to get that again.
c) Not Hiring A DWI Lawyer: If you think that a DWI case is very simple, then you are wrong. A DWI case cannot be won without an experienced DWI attorney. Hence, you need to hire a qualified DWI lawyer to defend your case. Sometimes the repercussions of a simple DWI case could be seen throughout one’s life. Loss of money, loss of job, loss of reputation and so on…to list a few.
d) Taking The Matter Leniently: Most people do not take the matter seriously. This is the biggest mistake they make. You must understand that charged with DWI case would mean that you could be criminally prosecuted in the court, may lose your driving license, face probation, jail and pay huge fines.
e) Not Listening And Cooperating With Your Attorney: Remember that by hiring an experienced attorney, you have done the half job, the rest (or best) half is all about listing to him, follow his instructions and cooperating with him in his proceedings.
f) Drive While The License Is Suspended: Never make a mistake of driving while the license is suspended. This is another serious crime that would result in your immediate arrest and a separate prosecution.
g) Not Arriving In Court As Per Schedule: Not arriving in court on time is another offence. This may result in your bond being forfeited.

Not Asking The DWI Lawyer About His Or Her Experience: You must ask about the experience of the DWI lawyer prior to hiring him or her. Ask clearly the number of years he has been into this field, how many successful DWI cases he or she has handled previously, and are there any references you can contact personally etc. Remember, this is an important decision that can make or mar the whole GAMEPLAN.
